1) Who we are and what these Terms cover

These Terms apply to the websites mytherapist.ie and learn.mytherapist.ie (including courses hosted and delivered via Teachable) and any related digital courses, screening tools, tests, downloads, articles, emails and resources (together, the “Services”).

The Services are operated by Moodsmith Ltd (Company No. NI649617), a private limited company, trading as MyTherapist.ie and Dr Elaine Ryan (“we”, “us”, “our”).

2) Acceptance of these Terms

By accessing or using the Services (including browsing content, using screening tools/tests, purchasing or accessing a course), you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

3) Adults only (18+) — and not for purchase/use on behalf of minors

The Services are intended for adults aged 18 years or older only.

By purchasing, enrolling in, accessing or using the Services, you confirm that you are 18+.

You also agree that you will not purchase, enrol in, access, share, or use the Services for or on behalf of any person under 18 (including any child, teen, or dependent), and you will not provide course access, materials, logins, downloads or worksheets to any person under 18.

4) Psychoeducational self-help only — not therapy or a clinical service

The Services provide psychoeducational self-help information and training for educational and informational purposes only.

The Services are not:

  • psychotherapy/therapy or counselling
  • medical advice or healthcare
  • a mental health assessment
  • a diagnosis
  • a treatment plan
  • crisis support or emergency services

Nothing on the Services creates a therapist–client / psychologist–client relationship.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical or mental health condition.

5) Screening tools, quizzes and “tests” (non-diagnostic)

Any questionnaires, quizzes, “tests,” scores or screening tools are provided for self-reflection and educational purposes only. They are not diagnostic tools, do not provide a clinical diagnosis, and are not a substitute for assessment by a qualified professional.

6) Self-help use is not monitored — no follow-up — no individual advice

Where the Services are accessed as self-help, you acknowledge and agree that:

  • your use of the Services is not monitored, reviewed, supervised or managed by a clinician (including Dr Elaine Ryan);
  • we are not required to follow up with you outside automated platform features (e.g., automated emails, reminders, progress markers); and
  • we do not provide individualised clinical advice, assessment, diagnosis, treatment planning, medical advice, crisis support, safeguarding support, or individual recommendations by email, messaging, comments, or through the Services.

7) Not for emergencies / crisis

The Services are not suitable for urgent situations or emergencies and are not a crisis service.

If you are in crisis, at risk of harming yourself or someone else, or require urgent medical or mental health attention, seek immediate help from local emergency services and/or urgent/crisis supports available in your location.

8) Worsening symptoms / stop if you feel worse

Individual responses to self-help content vary. In some cases, focusing on mental health topics may temporarily increase distress.

If you feel worse, your symptoms worsen, you become concerned about your wellbeing or safety, or you are unsure about suitability, you should stop using the Services and seek support from an appropriately qualified healthcare professional.

9) Suitability; severe/acute needs; “complex needs” and close clinical oversight

The Services are intended as general adult self-help and may not be suitable for everyone.

The Services are not recommended for use where you are currently suicidal, at risk of self-harm, in crisis, experiencing acute/severe distress, or where you require urgent or close clinical supervision.

If you are under the care of a qualified clinician, you should use the Services only as an adjunct and only if you (and/or your clinician) consider them appropriate for you. The Services must not be relied upon as a replacement for clinical care.

10) No guaranteed outcomes

Results vary between individuals. We do not guarantee any specific outcome, improvement, or results from use of the Services.

11) Accounts and access (learn.mytherapist.ie / Teachable)

To purchase and access paid courses, you may need to create an account on learn.mytherapist.ie (Teachable). You are responsible for maintaining the confidentiality of your login details and for all activity under your account.

You must not share your login details or allow others to access paid course content through your account.

12) Course access duration (12 months)

Unless stated otherwise at the point of purchase, each paid course includes 12 months of access from the date of purchase (“Access Period”).

After the Access Period ends, access may be removed and you may need to repurchase to regain access.

13) Prices and payment

Prices are displayed at checkout and may change from time to time. Payments are processed by Teachable and its payment providers. We do not store full payment card details.

14) Refund policy (10 days)

We offer a 10-day refund policy from the date of purchase, unless stated otherwise at checkout.

To request a refund within 10 days, email help [at] mytherapist [dot] ie and include:

  • the email address used at purchase
  • the course name
  • the purchase date and/or receipt

Approved refunds are returned to the original payment method where possible. Access to the course may be removed once a refund is issued.

Nothing in this section limits any mandatory consumer rights that apply to you under applicable law.

15) Digital content — immediate access and cancellation rights (important)

If you purchase digital content and request access immediately, you may lose certain cancellation rights once supply begins, where the law allows and where required consents/acknowledgements are provided.

16) Licence to use course materials (personal use only)

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable licence to access and use the Services for your personal, non-commercial use only during the Access Period (for paid content) or while the content is made available (for free content).

17) Intellectual property

All content in the Services (including videos, audio, worksheets, text, graphics, logos, branding and course materials) is owned by or licensed to Moodsmith Ltd and is protected by intellectual property laws.

You must not copy, reproduce, distribute, resell, publicly display, upload, share, or create derivative works from any part of the Services except as explicitly permitted by these Terms.

18) Prohibited use

You must not:

  • use the Services for any unlawful or harmful purpose;
  • share your login or allow anyone else to access paid content through your account;
  • scrape, hack, reverse engineer, bypass security measures, or interfere with the platform;
  • upload or transmit malware;
  • post or transmit content that is abusive, defamatory, harassing, threatening, or otherwise unlawful.

We may suspend or terminate access (and/or remove content) if you breach these Terms.

19) Third-party platforms and links

learn.mytherapist.ie is hosted via Teachable. We may link to third-party websites or services for convenience. We do not control and are not responsible for third-party content, availability, or practices.

20) Disclaimers

The Services are provided on an “as is” and “as available” basis. While we take reasonable care in preparing content, we do not guarantee that the Services will always be available, uninterrupted, timely, secure, error-free, or suitable for every user.

21) Limitation of liability (important)

To the maximum extent permitted by law, we are not liable for any loss or damage arising from or connected with your use of (or inability to use) the Services, including where such loss or damage is claimed to result from reliance on the Services or from the Services not meeting your expectations.

To the maximum extent permitted by law, we exclude liability for any indirect, incidental, special or consequentialloss, and for loss of profit, revenue, business, goodwill, or opportunity.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited, including liability for death or personal injury resulting from negligence, or for fraud/fraudulent misrepresentation.

22) Changes to these Terms

We may update these Terms from time to time. The “Last updated” date shows when changes took effect. Continued use of the Services after changes are posted means you accept the updated Terms.

23) Governing law

These Terms are governed by the laws of Northern Ireland, subject to any mandatory consumer protections that apply in your country of residence.

24) Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions will remain in effect.
